Arizona is a non-judicial foreclosure state under A.R.S. § 33-807 et seq. — 90-day NTS period, no post-sale redemption, civil lawsuit required to stop sale.
Under A.R.S. § 33-808, the Notice of Trustee Sale must be recorded at least 90 days before the sale date and published in a newspaper of general circulation. Defects in the NTS — improper recording, insufficient notice, or incorrect amounts — are grounds for a TRO and civil complaint.
The Arizona Consumer Fraud Act (A.R.S. § 44-1521 et seq.) prohibits deceptive acts in consumer transactions including mortgage lending and servicing. Violations can be asserted as claims in civil lawsuits with treble damages and attorney's fees available.
Arizona provides NO post-sale right of redemption for non-judicial foreclosures. Once the trustee sale is completed, the property is gone permanently. Pre-sale legal action — filing a civil lawsuit with TRO application in AZ Superior Court — is the only effective defense.
AZ non-judicial foreclosures are governed by A.R.S. § 33-807 et seq.:
| Stage | Timeline | Legal Authority | Homeowner Action |
|---|---|---|---|
| Notice of Trustee Sale | Recorded 90+ days before sale; published & posted | A.R.S. § 33-808 | 90-day window to file civil suit + TRO |
| Trustee Sale | Public auction at date/time/location specified in NTS | A.R.S. § 33-810 | No post-sale redemption — file BEFORE sale |
Total AZ timeline: approximately 90+ days from NTS recording. Act during the 90-day period — once the sale happens, you cannot get the property back.
