Act Early

Why Acting Early Matters in California

In California, most foreclosures proceed through a non-judicial trustee-sale process. That means options tend to be strongest before the sale, so acting early can preserve more choices for Monterey County homeowners.

Receive a Noticed

The process typically begins with a recorded Notice of Default. This starts the roughly 90-day cure/reinstatement window under the deed of trust.

Respond to the Notice

Use the window to pursue reinstatement, loss mitigation, or a loan modification — while checking the notice for accuracy under the Homeowner Bill of Rights.

Plan Before the Sale

A Notice of Trustee's Sale schedules a public auction. In the ordinary path there is generally no post-sale redemption, so options are strongest before the sale date.

Approximate timing: From delinquency to a Notice of Default, the period is often around 120 days (approximate), and from delinquency to a trustee sale the overall timeline is often around 200+ days (approximate). These are general figures, not guaranteed statutory deadlines — always confirm the dates on your own notices.

The Process

How a California Trustee-Sale Foreclosure Works

Most California foreclosures are non-judicial trustee sales under the deed of trust and Civil Code § 2924 — they do not begin as a lawsuit. A separate judicial path exists if you are served with a summons.

Trustee-Sale Process (Ordinary Path)

  1. 1

    Delinquency

Payments are missed, typically ~120 days before a Notice of Default is recorded (approximate).

  2. 2

    Notice of Default (NOD)

Recorded, mailed, and posted. Starts a ~90-day cure / reinstatement period.

  3. 3

    Notice of Trustee's Sale (NTS)

Recorded, mailed, and posted at least 90 days after the NOD. Sale scheduled at least 21 days after the NTS.

  4. 4

    Public Trustee Sale

A public auction at the location designated in the Notice of Trustee's Sale. The overall process is typically ~200+ days (approximate).

Redemption: In the ordinary non-judicial trustee-sale path, there is generally no post-sale redemption period.

Judicial Path (Separate)

A judicial foreclosure is a separate process. It begins when the lender files a lawsuit and you are served with a summons and complaint. You generally must answer within 30 days. Judicial foreclosure is not the ordinary trustee-sale path.

  • Filing a lawsuit alone does not automatically stop a trustee sale.
  • A civil challenge or lawsuit is separate relief from the non-judicial process.
  • A temporary restraining order or injunction is separate relief and is not automatic.
  • Summons and Answer language applies only to the judicial path.

Homeowner Bill of Rights (saved framework): § 2923.6 dual-tracking protections, § 2923.7 single point of contact, and § 2924.17 document accuracy.

The sale venue is the location designated in the Notice of Trustee's Sale. Court locations are for the judicial path only.

Loss Mitigation & Loan Modification

Under the California Homeowner Bill of Rights, servicers must follow dual-tracking protections (§ 2923.6) and provide a single point of contact (§ 2923.7). A complete loss mitigation application can pause the sale while it is pending.

Document Accuracy (§ 2924.17)

California requires accurate foreclosure documents. If notices contain material inaccuracies, they may be challenged through a separate civil lawsuit or court relief.
