Summons

Official court document served personally or by publication. It tells you that you have been sued, identifies the court and case number, and states the deadline to respond. The clock starts ticking from the date of service.

Motion for Default Judgment

If you do not file an Answer within 30 days, the lender files this motion. The court may enter an Order of Default, allowing the foreclosure to proceed without further notice to you. This is the most dangerous document.

Judgment of Foreclosure & Sale

If the court rules for the lender, it issues a Judgment of Foreclosure and Sale. This authorizes the sheriff to sell the property at public auction. Illinois law requires publication of the sale notice for 3 consecutive weeks.

Order of Possession / Eviction

After the sale is confirmed, the new owner may seek an Order of Possession. The sheriff will serve notice that you must vacate the property. Illinois law provides a minimum notice period before eviction can occur.
