How Foreclosure Works in Los Angeles County

California allows both non-judicial and judicial foreclosure. In Los Angeles County — with the highest volume of foreclosures in California — approximately 90% proceed non-judicially under CA Civil Code § 2924. The LA County Superior Court handles judicial foreclosures at the Stanley Mosk Courthouse (Central District) and branch courthouses across the county. Understanding which process applies to your situation is critical.

Non-Judicial Foreclosure

The most common type in LA County. The lender uses the "power of sale" clause in your deed of trust. No court involvement — but you must file a civil lawsuit to stop the trustee sale.

Notice of Default (NOD) — LA County Recorder

Recorded at the LA County Registrar-Recorder/County Clerk in Norwalk. You have 90 days to cure the default.

Notice of Trustee Sale (NTS)

Filed at least 90 days after NOD. Sets the auction date — typically 21+ days out. Auction held at LA County courthouse or designated location.

Trustee Sale / Auction

Property sold to highest bidder. NO right of redemption in CA. You must file a civil lawsuit in LA Superior Court BEFORE the sale date.

Judicial Foreclosure in LA County

Less common but used when no power of sale clause exists. The lender files in LA County Superior Court. You must answer within 30 calendar days.
