Minnesota allows both non-judicial foreclosure by advertisement and judicial foreclosure. Most Minnesota foreclosures proceed non-judicially. Understanding which path applies is the first step — they involve different notices, courts, and timelines.

Non-Judicial: Foreclosure by Advertisement

The standard Minnesota process when the power of sale applies. The lender follows a statutory notice and publication process, and the sale is conducted by the county sheriff — no court lawsuit is filed.

  1. 1 Default. The homeowner falls behind and the mortgage enters default.
  2. 2 Required notices. The homeowner receives notice of the foreclosure and the proposed sheriff sale.
  3. 3 Publication / advertisement. Notice of mortgage foreclosure sale is published for 6 consecutive weeks in a qualified newspaper, and the homeowner is served.
  4. 4 Sheriff sale. The county sheriff conducts a public auction. The highest bidder receives a certificate of sale.
  5. 5 Redemption period. After the sale, Minnesota provides a post-sale redemption period to reclaim the property by paying the bid amount plus interest.
Note on redemption: The saved Minnesota state source describes a 6-month post-sale redemption period for the non-judicial advertisement path — among the longest in the country. Redemption details can vary by the situation, so confirm the rule that applies to your case.

No Answer deadline applies in this path because it is not a court lawsuit. Deficiencies are limited in non-judicial foreclosures.

Judicial: Foreclosure by Action

An alternative process used when power of sale is unavailable or the lender seeks a deficiency. A foreclosure lawsuit is filed in Minnesota District Court and the homeowner is served with a Summons.

  1. 1 Complaint. The lender files a foreclosure action in the Minnesota District Court for the county where the property is located.
  2. 2 Summons & service. The homeowner is served with a Summons and the Complaint.
  3. 3 20-day Answer. The homeowner generally has 20 calendar days from service to file an Answer in the District Court.
  4. 4 District Court litigation. The court decides the case; defenses like standing, payment and arrears disputes, and notice defects can be raised.
  5. 5 Judgment / decree. If the lender prevails, the court enters a judgment or decree of foreclosure.
  6. 6 Sheriff sale & redemption. The property is sold, followed by Minnesota's post-sale redemption period.
